Question about att early termination fees.?

Me and my husband both have iPhones through att. We plan on paying out of our contract in February so we can go to straight talk but I have a question. If we were to go to a regular cell phone (non smart no data plan) for the next few months will we still pay the smart phone termination fee or the basic fee?
